General Terms and Conditions of Sale

Article 1: Purpose and Scope of Application

The purpose of these General Terms and Conditions of Sale (hereinafter "GTC") is to define the rights and obligations of LA VOILERIE (hereinafter "the Seller") and any adult natural person acting for personal purposes (hereinafter "the Customer") in connection with the sale of goods offered by the Seller.
These GTC are available at any time on the website www.lavoilerie.com or attached to any quote or contract. Placing an order by the Customer implies unconditional acceptance of these GTC.

Article 3: Products

Description
The products offered for sale The prices and sales information are described and presented on the website www.lavoilerie.com (or other media) with the greatest possible accuracy.
However, minor variations may occur, without the Seller being liable.
Availability
Product offers are valid as long as they are visible on the website or mentioned in sales documents, while stocks last. In the event of unavailability after an order has been placed, the Seller will inform the Customer as soon as possible and offer either a replacement product or cancellation of the order with a full refund.

Article 4: Price

Price Setting
The prices indicated are in euros (€) and include all taxes (TTC), excluding delivery costs. The Seller reserves the right to change its prices at any time. However, the price applied will be the one in effect at the time the order is confirmed.
Delivery Costs
Delivery costs are specified to the Customer before final confirmation of the order and appear on the order confirmation.

Article 5: Order

Order Process
The Customer selects the desired product(s) and adds them to the cart.
• The Customer checks the order summary (products, quantities, prices, and any applicable fees).
• The Customer enters the billing and delivery information.
• The Customer confirms the order after having read and unconditionally accepted these Terms and Conditions.
• The Seller sends an order confirmation email and/or proof of purchase.
Order Confirmation
All orders will be considered final after full payment of the price or according to the agreed payment terms. The Seller reserves the right to refuse or cancel any order in the event of fraud, payment incident, or prior dispute with the Customer.

Article 6: Payment

Payment Methods
Payment for purchases can be made by:
• Credit card (Visa, Mastercard)
• Bank transfer
• Check
The amount payable takes into account any discounts, rebates, or rebates granted by the Seller, which are specified at the time of ordering or in the current promotional conditions.
Security
The Seller implements procedures to ensure transaction security (secure payment platform, SSL protocol, etc.).

Article 7: Delivery

Delivery Time and Method
Products are delivered to the address indicated by the Customer when ordering, within the timeframe indicated on the product sheet or in the order confirmation. Delivery times are provided for informational purposes only and do not constitute a firm commitment by the Seller.
Delay or Non-Delivery
In the event of a significant delay, the Customer must inform the Seller so that an investigation can be conducted with the carrier. If the delay exceeds 21 days (except for sails) from the scheduled date, the Customer may request cancellation of the order and obtain a refund of any amounts paid.
Receipt of Products
Upon receipt, the Customer must check the condition of the package and products. Any anomalies (damage, missing products, damaged package) must be notified to the carrier and the Seller within 48 business hours.

Article 8: Right of Withdrawal

Duration
In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise their right of withdrawal without having to provide a reason or pay any penalties.
Exercising the Right of Withdrawal
To exercise this right, the Customer must inform the Seller of their decision by sending an unambiguous letter or email. The Seller may provide a standard withdrawal form.
Return of Products
The Customer must return the products in their original condition (undamaged packaging, accessories, instructions, etc.) to the address provided by the Seller, at the Customer's expense, unless otherwise provided by law. The Seller will reimburse the Customer within 14 days of receipt of the products or proof of shipment of said products.
Exceptions
The right of withdrawal does not apply to goods:
• Manufactured according to the Customer's specifications or clearly personalized. Sails fall into this category.
• They are liable to deteriorate or expire quickly,
• They are unsealed by the Customer after delivery and cannot be returned for reasons of hygiene or health protection,
• And, more generally, all cases provided for in Article L221-28 of the French Consumer Code.

Article 9: Warranties and After-Sales Service

Legal Guarantee of Conformity
The Seller is liable for any defects in conformity of the goods with the contract under the conditions provided for in Articles L217-4 et seq. of the French Consumer Code. If the product is not compliant, the Customer may request its repair or replacement. In the event of impossibility or disproportionate cost, the Seller may offer a partial or full refund.
Legal Warranty Against Hidden Defects
The Seller is bound by the warranty against hidden defects in the item sold that render it unfit for its intended use, in accordance with Articles 1641 et seq. of the French Civil Code.
Warranty Exclusions
The warranty does not cover damage resulting from misuse, defective maintenance, normal wear and tear, or work not authorized by the Seller.

Article 10: Liability

The Seller is liable only in the event of proven negligence in the performance of its obligations. The Seller shall not be held liable for any indirect or financial loss. In the event of proven non-compliance or defect of a product, the Seller's liability is limited to replacement or refund.

Article 11: Personal Data

The Seller undertakes to respect the confidentiality of the personal data collected from the Customer and to process it in compliance with applicable regulations (GDPR and the French Data Protection Act). The Customer has the right to access, rectify, object to, and delete data concerning them, which they may exercise by contacting the Seller at the email address indicated in Article 2.

Article 12: Dispute Resolution and Applicable Law

Applicable Law
These General Terms and Conditions are subject to French law. Complaints and Mediation
In the event of a dispute, the Customer must first contact the Seller's customer service to find an amicable solution. In accordance with Articles L612-1 et seq. of the French Consumer Code, the Customer may use a consumer mediator free of charge to resolve the dispute amicably.
Competent Courts
Failing an amicable agreement or mediation, any dispute will be brought before the competent courts of La Roche-sur-Yon (85) or the Customer's place of residence, according to the applicable law (individual or professional customer).

Article 13: Final Provisions

If any of the clauses of these General Terms and Conditions are declared null and void or inapplicable, the other provisions shall remain in full force and effect.
